page 5 - Step 3 of step 1

Step 3 of step 1;

It is important that you understand the patent laws concerning time. Once you have your Invention notarized, you have 2 years to file your utility patent. That is if you do not show the notary your Invention. If you show the notary or anyone else your Invention without having them sign a secrecy agreement you only have 1 year to file your utility patent.

So when you go to the notary, fold your papers in such a way that they are not able to see your drawings and descriptions. In other words fold the 4 inch blank spot on the bottom of each paper up so the notary can notarize the papers but can not see the documents. A simple explanation to the notary should be all one needs, and should they refuse, and I might say I have only had one do so, just go find one that will.

If you keep good notes and you are working on your handmade or machined prototype in a progresses way so you can perfect the Invention then you will be able to prove due diligence and you can take even more than 2 years. However it is not wise to allow any more time go by then is necessary. The sooner you file the utility patent the safer you will be. On the other side of the coin it is important that your Invention is perfected and does indeed work properly before you file your utility patent.

Being an Inventor one of the things I do to come up with an Invention is to look at automobile accidents around the world and try to figure out what invention could have prevented that accident from happening. This one particular accident left me dumfounded. These 3 men where out driving, one were in the cab of the pickup and the other 2 where inside the opened bed of the pickup. The truck hit a rail and went off a bride into a river. The driver managed to escape by rolling down his window and swimming to safety. But the two in the bed was seen drowning while trying to get the tail gate down.
